Commercial Dispute Resolution

Mediation and Arbitration proceedings can provide parties with efficient, flexible, and inexpensive final resolution of business disputes.

Arbitration is the submission of a dispute to one or more impartial persons for a final and binding decision, known as an “award.” Awards are made in writing and are generally final and binding.

Mediation is an assisted communication aimed at reaching an agreement; it also involves an impartial third person. The mediator does not have the authority to make a final or binding decision – hence resolution of the dispute is solely up to the parties.

Whether arbitration and mediation are required by an existing contract, or parties simply want to submit an existing dispute to arbitration or mediation proceedings, Markowicz International Law provides support through highly qualified and well-respected professionals with particular experience in the area of cross-border alternative dispute resolution.

We have represented domestic and international clients in mediation and arbitration proceedings under the American Arbitration Association (AAA), the Hong Kong International Arbitration Centre (HKIAC), and the International Chamber of Commerce (ICC).

The arbitration centers of which the firm is a member allow us to make virtual appearances through videoconferencing and electronic filing, thus avoiding the oftentimes extensive travelling and expense necessary to conduct arbitration.

We have advised our clients throughout all phases of domestic and international arbitration proceedings, including but not limited to:

  Information preparation and exchange
